Terms of Use

Welcome to the messaging service SMS (YAM) of Dataways. The services provided by your system YAM subject to the following Terms of Service ("TOS"), which the Dataways may notify from time to time without notice. In addition, when using these services Dataways, both you and Dataways be subject to any guidelines and rules for such services as may from time to time published by the Dataways. (All such guidelines and rules are hereby incorporated by reference to the TOS.) In most cases the guides and rules are specific to a particular section of the Service and will assist in applying the TOS to that part, but in case of any inconsistencies between the TOS and any directive or rule, the TOS shall prevail. Also, at times Dataways may provide services that are governed by different terms of service. In such cases the other terms of service will be published.

2. DESCRIPTION OF SERVICES

H Dataways gives users access to a collection of electronic resources and applications, including various communications tools to send messages SMS ("Services"). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including new services Dataways, subject to the TOS. This is to acknowledge and agree that the Service is provided "AS IS" and that Dataways no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

To use the Service, you must access the World Wide Web, either directly or through devices that access to content-based web, and pay any service and / or costs associated with such access . In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

3. DUTIES OF THE REGISTER

In connection with the use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information are the "Registration Data" ) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. 5. MEMBER ACCOUNT, PASSWORD AND SECURITY

When you finish

Service's registration process, you will receive a password and an account designation. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur using your password or account. You agree to (a) immediately notify the Dataways of any unauthorized use of your password or account and any other breach of security, and (b) ensure that you exit from your account at the end of each session. The Dataways can not and will not be held responsible for any loss or damage arising from your failure to comply with Section 5.

6. MEMBERS CONDUCT

Agree that all information, data, text, messages and other materials ("Content"), whether published or broadcast in shares as private, are the sole responsibility of the person from which such Content originated. This means that you, not Dataways, have full responsibility for the Content that you upload, post, send an SMS, or otherwise transmit via the Service. H Dataways not control the Content published via the Service and, therefore, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Services, you may be exposed to offensive, inappropriate or disturbing content. The Dataways in any way and in no way be held liable for any Content, including, without limitation, any errors or omissions in any Content, or for any loss or damage of any kind resulting from the use of the Content published or sent an SMS message transmitted by otherwise through the Services.

You agree not to use the Services to: sent by SMS or otherwise transmit any Content is unlawful, harmful, threatening, abusive, harassing, libelous, defamatory, vulgar, obscene, libel is a violation of privacy of another, shows empathy, or reflect racial, ethnic or other discrimination, harm minors in any way impersonate any person, including, without limitation, its employees Dataways, the perpetrators, the forum hosts, or a false statement or misrepresentation of your affiliation with a person or entity, falsify headers or otherwise counterfeiting identifiers to disguise the origin of any Content transmitted through the Service, and sending an SMS, or otherwise transmit any Content for which you have no right to broadcast in accordance with the law or contractual relations or management (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or subject to confidentiality agreements), upload, send by SMS or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ( "Rights") third, upload, post, email via SMS or otherwise transmit any unsolicited or unauthorized advertising material, spam, spam (mass mailings, mazikoSMS), chain letters, pyramid-formatted mail, or any other form of invitation except in areas (such as commercial sites) are designed for this purpose, upload, post, email via SMS or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interruption, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or other actions that adversely affect the ability of other users to participate in information exchanges in real time, causing interference or interruptions in services or servers or networks connected to the Services or breach of any requirements, procedures, conditions or provisions of networks connected to the Service, intentional or unintentional violation of applicable laws or rules, including, without limitation, harass third parties in any way, or collect or store personal data about other users. You agree that Dataways not check in advance the content, but that Dataways and indicated this person would have the right (but not the obligation) in their sole discretion, refuse or move any part of Content that is available via Services. Notwithstanding the preceding conditions, the Dataways and its designees shall have the right to remove any element of the Content that violates the TOS or is otherwise objectionable. Agree that you must evaluate, and accept all risks associated with the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. Accordingly, you acknowledge that you may not rely on any Content created by the Dataways or submitted to Dataways.

7. SPECIAL MENTION FOR INTERNATIONAL USE

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country where you reside, the United Kingdom and the United States.

8. COMPENSATION

You agree to indemnify and hold the Dataways from any claim or demand, affiliates, officers, agents, other partners and employees, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post or transmit through the Service, use of the Service, your connection to the Service, any breach by you of the TOS or the rights of others.

9. PROHIBITION OF RESALE OF SERVICE

Not reproduce, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Services or access to services without prior permission from Dataways.

10. GENERAL PRACTICES REGARDING USE AND STORAGE

You agree that Dataways may establish general practices and limits concerning use of the Services. You agree that Dataways no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You agree that Dataways reserves the right to log off accounts that are inactive for an extended period. You further acknowledge that Dataways reserves the right to modify these general practices and limits at any time at its discretion, with or without notice.

11. MODIFICATION OF SERVICES

The Dataways reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

12. EXPIRATION

The Dataways in its sole discretion, may terminate your password, account (or any part thereof) or your use of the Service, and remove and discard any Content within the Service, for any reason, including but not limited of non-use or if the Dataways assume that you have violated or acted inconsistently with the letter or spirit of the TOS. Also, at the discretion of the Dataways may at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and you acknowledge and agree that Dataways may immediately deactivate or delete your account immediately and all related information and files your account and / or bar any further access to such files or the Service. You further agree that Dataways no responsibility to you or any third party for any termination of your access to the Service.

Services, or third parties may provide, links to other sites or resources World Wide Web. Because Dataways has no control over such sites and resources, you acknowledge and agree that Dataways is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Dataways not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods and services available or through any such site or resource.

14. PROPRIETARY RIGHTS DATAWAYS

You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information protected by applicable copyright laws and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part, unless expressly authorized by the Dataways or customers. H Dataways grants you a personal, non-transferable and non-exclusive right and license to use the Services, provided that it will not (and will not allow any third party to) copy, modify, create a derivative work of, in reverse engineering, reverse assemble or otherwise attempt to discover any source code, sell, assign, lease or otherwise transfer any right in the Services. The foregoing are subject to applicable law. You agree not to access the Service by any means other than through the interface that is provided by Dataways for use in accessing the Service.

15. NO WARRANTIES

You acknowledge and agree that: UNDERTAKES FULLY THE RISK OF THE USE OF SERVICES. THE SERVICES ARE PROVIDED "AS IS" AND "Subject to availability. TO THE MAXIMUM EXTENT PERMITTED current legislation, H DATAWAYS EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND OTHER TERMS OF ANY KIND, OR RITOUS SIOPIROUS, INCLUDING WITHOUT LIMITATION ANY IMPLIED CONDITION FOR MERCHANTABILITY, IKANOPOIITIKIS QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND ANY CONDITION AS TO PROVIDE SERVICES IN A NORMAL LEVEL OF SERVICE AND SKILLS Bless OR AS TO NON-INFRINGEMENT OF INTELLECTUAL PROPERTY. The DATAWAYS MAKES NO WARRANTY OR PROMISE THAT (i) THE SERVICES WILL MEETS YOUR REQUIREMENTS, (ii) THE SERVICES WILL BE ADIALEIPTES, EGKAIRES, SECURE OR ALANTHASTES, (iii) THE RESULTS WHICH MAY BE OBTAINED FROM USE OF THE SERVICE WILL Is it expensive or reliable, (iv) quality in products, services, information or other material purchased or acquired through the Service WILL MEETS YOUR EXPECTATIONS, AND THAT (V) ANY ERRORS IN THE SOFTWARE will be corrected. Taking or otherwise ACQUISITION OF ANY MATERIAL THROUGH THE USE OF THE SERVICE IS AT YOUR DISCRETION AND WITH YOUR OWN RISK AND YOU HAVE THE EXCLUSIVE LIABILITY FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA ON caused by the taking of such materials.

16. LIMITATION OF LIABILITY

You acknowledge and agree that H DATAWAYS YPEFTHYNH will not be for any direct, indirect, contingent, or consequential damages, WITHOUT LIMITATION, but not limited to damages from lost profits, YPERAXIAS, USE, DATA OR OTHER AVLES LOSSES (EVEN IF H DATAWAYS aware ON THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE, (ii) THE COST OF PROCUREMENT substitute goods and services stemming from GOODS, DATA, INFORMATION OR SERVICES purchased or obtained or messages received TRADE OR IMPORTED BY OR THROUGH SUCH SERVICES, (iii) NON-AUTHORIZED ACCESS TO OR TRANSMISSION OF YOUR DATA OR MODIFICATION THEREOF, (iv) STATEMENTS OR ACTIONS OF ANY THIRD PARTY ON SERVICES, OR (v) Any other matter relating SERVICES.

Agree that regardless of any provision or law which provides otherwise, any claim or BASED EDUCATION IN RESPECT OF, OR RELATED TO, THE USE OF SERVICES OR THE TOS MUST BE OFFICIALLY STATES WITHIN ONE (1) YEAR FROM THE CREATION OF THIS AXIOSIS BASE OR THE CLAIM, OTHERWISE BY PANTOS be extinguished.

17. SMS MESSAGE DELIVERY

The Dataways every effort is made to the delivery of messages to recipients in no time.

The Dataways but does not guarantee in any way the supply of incoming SMS messages to the recipient within a specified time limit. Using the service is agreed that any possibility of late or non delivery messages SMS, the Dataways assumes no liability for any direct or indirect damage caused.

18. EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CONSEQUENTIAL DAMAGES OR PERISTASIAKES. THEREFORE, THE ABOVE FROM CERTAIN RESTRICTIONS of sections 15 and 16 MAY NOT APPLY TO YOU.

Specifically, EITHER BY TOS shall affect the statutory right ANY CONSUMER, NOR exclude or limit their liability for death or injury caused by negligence or willful misconduct of DATAWAYS.

19. SPECIAL MENTION FOR SERVICES RELATING TO FINANCIAL MATTERS

The Dataways is not responsible for the accuracy, usefulness or availability of any information transmitted via the Service and is not responsible for any trading or investment decisions made based on such information.

20. ALERTS

The alerts you receive may be made via email or regular mail. The Service may also provide notices of changes to the TOS or other matters by displaying notices or links to notices generally on the Service.

21. TRADEMARKS INFORMATION

The signal Dataways, logo Dataways, and other logos and product and service names are the trademarks Dataways of DATAWAYS SA. Without prior approval of Dataways, you agree not to display or use in any manner these marks.

22. COPYRIGHT AND INSTITUTIONS OF INTELLECTUAL PROPERTY RIGHTS

H Dataways respects the intellectual property of others and we ask our users to do the same. If you believe any of your copyright has been infringed on the Service, please provide the following information Dataways by mail or e-mail address sms at dataways.gr: an electronic or a real signature of person authorized to act on behalf of holder of copyright, a description of the protected by copyright work that you claim has been infringed, a description of the exact point of the site where the material that you claim that it creates a breach, address, phone number and e- mail, a statement that you, in good faith, believe that the disputed use is not authorized by the holder of copyright, institution, or the law, a declaration from you under penalty of false witness, that the above information is accurate and that you are the owner of copyright or that you are authorized to act on behalf of the copyright holder.

23. GENERAL INFORMATION

These TOS (including directives and regulations mentioned herein) constitute the entire agreement between you and Dataways and govern your use of the Service, superseding any prior agreements between you and Dataways. Might also are subject to additional terms and conditions when you use affiliate services, third-party content or third party software. The TOS and the relationship between you and Dataways governed by the laws of Greece and the European Union. You and Dataways agree to submit to the exclusive jurisdiction of Greek courts. Any failure to exercise or Dataways impose conditions or provisions of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found invalid by a court of competent jurisdiction, the parties agree that the court should endeavor to give effect to the intentions of the parties as shown by the order, and the other provisions of the TOS remain in full force.

The headings of the TOS are aimed exclusively at your convenience and have no legal or contractual effect.
